Family law in Estonia
protecting family rights and interests respectfully and professionally
Do you plan to divorce, divide property, or resolve custody issues?
Stella Einla Law Firm offers professional assistance in all matters of Estonian family law – from divorce at a notary public to child custody, joint residence disputes, and alimony collection.
Relevance and key facts
1. A divorce can be registered with the Vital Statistics Office or a notary, if the spouses agree and both reside in Estonia. The proceedings take 1–3 months after the application is submitted. We also assist in filing for divorce through the court, if one of the spouses does not consent to the divorce voluntarily. The proceedings take about the same amount of time.
2. Legal custody is regulated in §§ 119-146 of the Family Law Act: parents are entitled to demand the transfer of authorisation on reasonable grounds, the court takes into account the interests of the child, including the right of minors over 10 years of age to express their opinion.
3. The obligations to pay support are laid down in the Constitution of the Republic of Estonia: parents, spouses, and relatives are obliged to support family members in need of assistance – maintenance may be determined as a regular payment or as a lump sum.
